NOLAN offers the possibility of publishing reviews on its website accessible at the address https://www.nolan-helmets.com.
The publication of a review on the Site implies acceptance and compliance with these publication conditions (hereinafter the «Publication Conditions»). NOLAN reserves the right to modify them at any time. If we do so, we will notify you by changing the date at the bottom of these Terms of Service and, in some cases, we will provide additional notification (for example, by posting a statement on the main pages of our Site or by sending you an email).
Article 1 - Object of the Site's reviews functionality
1.1 The reviews functionality allows users to leave reviews, advice, suggestions, information and recommendations on products marketed by NOLAN and to assign them a rating from one star ("Poor") to five stars ("Excellent").
1.2 The NOLAN company makes available to users (hereinafter the "User" or "Users") a space to exclusively archive their reviews for the purpose of their dissemination on all NOLAN's current and future public communication media, in particular and without exhaustive nature, electronic communication services (in particular the commercial sites of the 2RIDE Group and/or any possible declination on mobile devices) and marketing and/or advertising communication media (emailing, mailing, advertising banners on the Internet, promotional media in NOLAN stores…) published by NOLAN.
Article 2 - Deposit, badge and classification of reviews
2.1 Each User of the NOLAN reviews functionality must accept the Publication Conditions. NOLAN may require any minor User to justify such authorization and, failing that, refuse to post a review.
2.2 Users have the opportunity to leave their reviews in the following ways:
- spontaneously, on your own initiative, by clicking on «Leave your review» on the page of the product concerned. In this case, NOLAN is unable to confirm that the User is reviewing a product that he has actually purchased or tested. These are reviews for which no badge or specific mention is affixed, as well as those identified by a "spontaneous review" badge.
- following receipt of an email inviting them to review a product purchased from NOLAN. Since these reviews are solicited by NOLAN following a purchase, they are identified on the Site by a "verified buyer" badge.
2.3 Reviews are by default displayed in chronological order, from newest to oldest, but users can choose to view them by other criteria such as helpfulness or rating.
Article 3 - Content of Reviews / User Responsibilities
3.1 A review must contain a pseudonym, a rating, a title and a description of at least 50 characters.
3.2 The reviews function cannot be used as a support for the dissemination of content contrary to morality, public order, the rights of others or applicable laws and regulations, such as in particular:
- statements or messages of a defamatory, abusive, obscene, racist, offensive nature or which mention illegal activities in all their forms.
- any abuse in the exercise of freedom of expression, such as statements consisting of systematic or non-objective criticism, as well as statements of a disparaging or malicious nature.
- content of a violent or pornographic nature, or likely to undermine respect for the human person or his dignity, equality between women and men or the protection of minors.
- statements or messages that incite the commission of crimes, violence, discrimination or racial hatred.
- the usurpation of a name, email or company name.
- the total or partial reproduction of contents protected by intellectual property rights for which Users do not have rights, as well as messages constituting counterfeiting of a registered trademark.
3.3 Users are prohibited from using the reviews functionality to carry out propaganda, prospecting, solicitation or proselytism, for professional, commercial or political purposes (advertisements, "spam" content or references to other products, commercial offers or Internet sites...).
3.4 Reviews must not contain in particular:
- email addresses, URLs, telephone numbers, postal addresses or other information (name, surname...) that allows the User or a third party to be identified.
- critical comments on other reviews published in particular on the Site or on their authors.
- comments on the medical effectiveness of the products.
- comments relating to another product or problems encountered during orders (delivery problems...).
- comments that encourage you to purchase from a NOLAN competitor.
3.5 The content of the reviews must not be contrary to these Publication Conditions.
3.6 Users are also prohibited from hindering or disturbing the functioning of the NOLAN reviews functionality.
Users are prohibited from incorporating documents or software into the reviews stored in the storage space made available by NOLAN which may damage the computers of other users or allow unauthorized access to other websites.
It is up to Users to take all appropriate measures relating to the equipment they use to protect such equipment from any virus contamination or intrusion attempts. By equipment we mean in particular, without this list being restrictive or exhaustive: personal computer, personal digital assistant PDA, Internet access, software programs and data…
3.7 Users are solely responsible for all content they transmit via the NOLAN reviews feature.
Article 4 – Moderation and publication of Reviews
4.1 The reviews and the pseudonyms that accompany them are systematically subject to moderation carried out by software based on keywords predefined by NOLAN and, in some cases, to a re-reading by moderators before they are put online on the Site.
NOLAN reserves the right not to publish any review that contravenes the provisions set out in these Publication Conditions. In this case, the User will be informed via email notification.
NOLAN does not edit reviews, but can correct minor spelling or typing errors without changing the meaning of the submitted review. Furthermore, NOLAN also reserves the right to delete a review that does not comply with the Terms of Use at any time.
Once submitted, a review can no longer be modified by the User.
4.2 Reviews are published on average within two to four working days of their receipt by the User, subject to compliance with the Publication Conditions.
The User will receive an email confirming the publication of their review or, otherwise, notification of its rejection. Any subsequent use of the review under the conditions set out in article 1.2 above will not result in the sending of a new email.
4.3 As soon as a review is published on the Site, users have the possibility, via a specific link, to indicate whether they found it useful or not and to report content that they consider inappropriate. In this case, NOLAN will take note of the reports and may delete a review that does not comply with these.
4.4 Reviews are published on the Site for a maximum duration of 10 years. They may be eliminated by NOLAN before this deadline if they concern a product that is no longer marketed by NOLAN or whose characteristics have been modified so much as to make the reviews irrelevant.
Article 5 - Intellectual property
5.1 NOLAN is the owner of all intellectual property rights both on the structure and on the content of the reviews functionality of the Site (including, without this list being restrictive: texts, logo, images, illustrations, photographs, videos, graphic or sound elements, music, icons, layout, graphic paper, software, databases...) or has regularly acquired the rights/authorizations that allow their exploitation. All trademarks and/or logos reproduced on the NOLAN reviews feature are the exclusive property of NOLAN, or its service providers, partners or suppliers.
Any use of these elements, in any way and for any reason, other than the use strictly necessary for the dissemination of the User's review as defined herein, is prohibited without express, written and prior authorization from the NOLAN company or the owner of the intellectual property rights concerned.
In general, the User is prohibited from infringing the intellectual property rights (copyright, related rights, sui generis rights of the database producer, trademark rights, domain names, etc.) of NOLAN, the companies of the 2ride group and/or any third party. Any unauthorized or abusive use of intellectual property rights may result in NOLAN or any interested third party adopting any measure or sanction that is appropriate.
5.2 By depositing their review on the Site, Users expressly and free of charge consent to the NOLAN company disseminating, reproducing and representing all or part of their reviews as well as their pseudonym by any means of reproduction and representation and on all media throughout the world and for a duration of 10 years.
The media used may in particular be graphic and paper media, audiovisual, IT and digital communication media such as CD-ROM, DVD, electronic communication services (in particular the commercial sites of the 2ride Group and/or any possible declination on mobile devices) and marketing and/or advertising communication media (emailing, mailing, advertising banners on the Internet, promotional media in NOLAN stores...) published by NOLAN, and all media known or to be discovered in the future.
This authorization entails in particular the possibility for NOLAN to freely and free of charge use all or part of the reviews and pseudonyms, to reproduce them, eliminate them in whole or in part, adapt them, publish them, translate them, create derivative works, sell them, distribute them in particular for commercial, promotional and advertising purposes.
Article 6 - Personal data
As part of the reviews functionality, NOLAN collects personal information (in particular e-mail, pseudonym, city, age group, gender, skin type, eye color) of Users who leave a review on the Site.
Only the fields marked with an asterisk in the collection form are mandatory information to be able to leave a review on the Site. Otherwise, the User will not be able to leave their review.
Users are informed that all or part of their personal data thus collected by NOLAN may be used by the latter, and if applicable by its service providers, for the dissemination of the review on NOLAN's current and future public communication supports, in particular and without exhaustive nature the electronic communication services (in particular the commercial sites of the 2ride Group or any possible declination on any mobile device) and/or the marketing and/or advertising communication supports (emailing, mailing, advertising banners on the Internet, promotional media...) published by NOLAN.
The personal data that will be used for this dissemination may be: pseudonym, city, age group and gender.
To comply with its legal obligations, NOLAN is also likely to collect and store data that allows the identification of anyone who has contributed to the creation of online content.
